The Central Bank of Aruba (CBA) has taken note of the press release issued by the Central Bank of Curaçao and Saint Martin (CBCS) dated October 7, 2023 (PB 2023-033), titled Update over herstructurering Ennia.
In this press release, the CBCS announces that it will not pursue a re-launch, but that it will work on a phased and controlled wind-down of Ennia Caribe Leven NV (ECL) in the coming weeks. It is also announced that the CBCS will further develop this scenario in collaboration with the governments of Curaçao and Saint Martin and that ‘naturally it needs to be considered how best to deal with the healthy entities of the Ennia-group (…)’. In this context, the CBCS also mentions Ennia Caribe Schade (Aruba) N.V. and Ennia Caribe Leven (Aruba) N.V.
Regarding the Aruban Ennia-entities, the CBA notes that prior approval from the CBA is required before any lawful decision can be taken with regard to these entities.
The CBA has the duty to ensure the stability of the institutions under its supervision and it will not hesitate to take measures – if necessary – to safeguard the interests of the policyholders of the Aruban Ennia-entities nor will it hesitate to take immediate action against parties that act without prior permission from the CBA with regard to the Aruban Ennia-entities.

De Centrale Bank van Aruba (CBA) heeft kennisgenomen van het persbericht van de Centrale Bank van Curaçao en Sint Maarten (CBCS) van 7 oktober 2023 (PB 2023-033), getiteld Update over herstructurering Ennia.
In dit persbericht deelt de CBCS mee dat zal worden afgezien van een doorstart en dat de komende weken zal worden gewerkt aan een gefaseerde en gecontroleerde afwikkeling van Ennia Caribe Leven NV (ECL). Aangekondigd wordt verder dat de CBCS dit scenario verder zal uitwerken samen met de regeringen van Curaçao en Sint Maarten en dat ‘vanzelfsprekend ook [zal] moeten worden bezien hoe het best om te gaan met de gezonde onderdelen van de Ennia-groep (…)’. In dit kader noemt de CBCS ook Ennia Caribe Schade (Aruba) N.V. en Ennia Caribe Leven (Aruba) N.V.
Ten aanzien van de Arubaanse Ennia-entiteiten merkt de CBA op dat voorafgaande toestemming van de CBA noodzakelijk is, alvorens enige rechtmatige beslissing ten aanzien van deze entiteiten kan worden genomen.
De CBA heeft tot taak de stabiliteit van de onder haar toezicht staande instellingen te waarborgen en zal niet schromen om – zo nodig – maatregelen te treffen ter borging van de belangen van de polishouders van de Arubaanse Ennia-entiteiten en ook onverwijld op te treden tegen partijen die handelen zonder verkregen voorafgaande toestemming van de CBA met betrekking tot de Ennia Aruba-entiteiten.
